Terms of Use

1. Purpose

These Terms of Use (the “Terms”) set out the conditions for accessing and using the PokerFlow application (the “Service”), published by PFLOW. The financial terms of the subscription are set out in the Terms of Sale.

2. Publisher

PokerFlow is published by PFLOW, a simplified joint-stock company (SAS) registered with the Trade and Companies Register under number 944 586 437, with its registered office at 162 Clos des Vignes, 38300 Meyrié, France. For more information, see our legal notice.

3. Acceptance

Using the Service implies full acceptance of these Terms. A user who does not accept these Terms must refrain from using the Service.

4. The Service

PokerFlow is a desktop application that automatically tracks poker players’ results, bankroll and playing statistics from imported hand histories. PokerFlow is a tracking and accounting tool: it does not offer any gambling service and does not organise any game.

5. Access and account

Access to the Service requires creating an account. Authentication is handled through Amazon Cognito. The user agrees to provide accurate information, keep their credentials confidential and not share them. Any activity carried out from their account is deemed to be performed by them. The Service is reserved for adults with the legal capacity to contract.

6. Acceptable use

The user agrees to use the Service for its intended purpose and in accordance with applicable law. In particular, the user shall not:

• attempt to gain unauthorised access to the Service, its servers or other users’ accounts;
• copy, modify, decompile or reverse-engineer the software, except where permitted by law;
• disrupt the operation of the Service or compromise its security;
• resell, sub-license or commercially exploit the Service without PFLOW’s written consent.

7. Licence

For the duration of the subscription, PFLOW grants the user a personal, non-exclusive and non-transferable right to use the PokerFlow software. This licence does not transfer any ownership of the Service or its components.

8. Intellectual property

All elements of the Service (the PokerFlow brand, logo, software, text, visuals, interface) are protected by intellectual property law and remain the exclusive property of PFLOW. Any reproduction or representation, in whole or in part, without prior written authorisation is prohibited. The game data imported by the user remains the user’s property.

9. Personal data

The user’s personal data is processed in accordance with our privacy policy and the General Data Protection Regulation (GDPR).

10. Availability and changes

PFLOW strives to keep the Service available and to improve it continuously. The Service may evolve, and some features may be added, changed or removed. PFLOW does not guarantee uninterrupted availability and may suspend access for maintenance or technical reasons.

11. Liability

The Service is a tracking and analysis tool. The results and statistics provided depend on the data imported by the user and are given for information only. PokerFlow does not constitute financial advice and does not guarantee any winnings. PFLOW cannot be held liable for the user’s gaming decisions or any resulting losses. Gambling is prohibited for minors and can be dangerous: risk of isolation, debt and addiction.

12. Suspension and termination

If the user breaches these Terms, PFLOW may suspend or terminate their access to the Service, where appropriate without notice in the event of a serious breach. The user may likewise stop using the Service and cancel their subscription under the conditions set out in the Terms of Sale.

13. Changes to the Terms

PFLOW may amend these Terms to adapt them to changes in the Service or in applicable regulations. Users are informed of material changes, which take effect upon publication.

14. Governing law

These Terms are governed by French law. Any dispute relating to their interpretation or performance falls under the jurisdiction of the competent French courts, subject to the protective provisions applicable to consumers.
